1. Acceptance of Terms
By accessing or using PiP Inbox services available at pipinbox.com and app.pipinbox.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and PiP Inbox.
2. Description of Service
PiP Inbox is a comprehensive email marketing platform that provides tools for creating, sending, and managing email campaigns. Our service is built on robust Amazon SES infrastructure and includes advanced features such as email validation, marketing automation, real-time analytics, and custom SMTP integration to ensure high deliverability and campaign success.
3. User Accounts
3.1 Account Creation & Eligibility
To use our Service, you must create an account by providing accurate, current, and complete information. You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials (username and password).
3.2 Account Responsibility
You are solely responsible for all activities that occur under your account, including the content of your email campaigns and the management of your subscriber lists. You agree to notify PiP Inbox immediately of any unauthorized use of your account or any other breach of security.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by any third party. You explicitly agree not to use the Service to:
- Send unsolicited commercial email (spam), bulk email messages, or any form of unauthorized advertising.
- Violate any applicable local, national, or international laws or regulations.
- Infringe on the intellectual property rights, privacy rights, or other rights of others.
- Transmit any malicious code, viruses, worms, or other harmful content.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the integrity or performance of the Service or data contained therein.
- Collect or harvest any personally identifiable information from the Service without explicit consent.
5. Anti-Spam Policy (Zero Tolerance)
5.1 CAN-SPAM Act & GDPR Compliance
PiP Inbox has a zero-tolerance policy for spam. All users must strictly comply with the CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography and Marketing Act) and other applicable anti-spam laws and regulations, including GDPR for European Union residents. This includes, but is not limited to:
- Obtaining explicit, verifiable consent from all recipients before sending them emails.
- Including accurate and non-misleading sender information in all emails.
- Providing a clear, conspicuous, and functional unsubscribe mechanism in every email.
- Honoring all unsubscribe requests promptly, within 10 business days.
- Using truthful and non-deceptive subject lines.
- Including your valid physical postal address in every email.
5.2 Permitted & Prohibited List Building
You must only send emails to recipients who have explicitly opted-in to receive communications from you. Acceptable methods of list building include:
- Website sign-up forms with clear consent.
- Opt-in checkboxes during checkout processes.
- In-person sign-ups where consent is clearly given.
The following methods of list building are strictly prohibited and will result in immediate account suspension or termination:
- Purchased, rented, or scraped email lists.
- Email addresses obtained from third-party sources without explicit consent.
- Any list where recipients have not directly and knowingly opted-in to your communications.
5.3 Enforcement & Penalties
We actively monitor our systems for spam and abuse. Any violation of our Anti-Spam Policy will result in immediate investigation and may lead to:
- Immediate suspension or termination of your account without notice.
- Forfeiture of any remaining sending credits or subscription fees.
- Reporting to relevant authorities and internet service providers.
- Legal action to recover damages caused by your spamming activities.
6. Pricing and Payment
6.1 Subscription Plans
We offer various subscription plans with different features, sending limits, and contact capacities. Current pricing details are available on our website's pricing page and may be updated from time to time. All prices are listed in USD unless otherwise specified.
6.2 Payment Terms
Subscription fees are billed monthly or annually in advance, depending on your chosen plan. You authorize us to charge your designated payment method for all applicable fees, including recurring subscription fees and any overage charges. All payments are due immediately upon billing.
7. No Refund Policy
IMPORTANT: All sales are final. We operate a strict no-refund policy for all services.
Due to the nature of our digital services, the immediate allocation of sending credits, and the infrastructure costs associated with email delivery and platform maintenance, we do not offer refunds for any subscription fees, setup costs, overage charges, or other payments made for our services. This policy applies to:
- Monthly and annual subscription fees, regardless of usage.
- Overage charges incurred for exceeding plan limits.
- Fees for any add-on services, features, or one-time purchases.
- Situations involving account suspension or termination due to violation of these Terms.
- Dissatisfaction with service performance or features.
You may cancel your subscription at any time from your account dashboard. Upon cancellation, no further charges will be applied, but no refunds will be provided for any unused portions of your current subscription period. Your service will continue until the end of your current billing cycle.
8. Data and Privacy
Your privacy and the security of your data are paramount to us. Our collection, use, and protection of personal information are governed by our comprehensive Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the terms of our Privacy Policy.
9. Service Availability & Disclaimers
While we strive to maintain high availability and performance, we do not guarantee uninterrupted or error-free service. We may perform scheduled or unscheduled maintenance, updates, or experience technical issues that temporarily affect service availability. PiP Inbox shall not be liable for any damages arising from such interruptions.
10. Intellectual Property
The Service and its original content, features, and functionality (excluding user-submitted content) are and will remain the exclusive property of PiP Inbox and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PiP Inbox.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
12. Limitation of Liability
In no event shall PiP Inbox, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PiP Inbox is registered, without regard to its conflict of law provisions.
14. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
